The EB-5 Reform and Integrity Act of 2022 (RIA) regulations were formally released today by a Notice of Proposed Rulemaking (NPRM). Comments are due August 31, 2026. The proposed rules are 358 pages and implement the RIA.

“Having worked closely with industry and Hill staffers on the EB-5 Integrity Act, I’m in favor of strong oversight. But USCIS oversight must have enforcement in equal measure with expertise and efficiency.“

– Carolyn Lee, quoted in Newsweek (July 1, 2026)

Principal Carolyn Lee worked extensively with industry and Congressional offices sponsoring the RIA. Carolyn Lee PLLC looks forward to working closely again with industry and bar colleagues in formulating comments to the NPRM.
