Under the EB-5 Reform and Integrity Act of 2022 (RIA), Regional Centers are required to pay $20,000 if they have more than 20 investors or $10,000 if fewer. These payments are mandated to be collected into a designated “EB-5 Integrity Fund.” RIA requires regional centers to pay annually starting October 1, 2022, due every October 1 thereafter. USCIS is authorized to impose a “reasonable penalty” if not paid within 30 days of the due date.
However, as of September 29, 2022, the USCIS website reports that USCIS is drafting and will soon publish a public notice with instructions on paying the Integrity Fund fee.
