Unanswered Question: Integrity Fund Fee Due October 1, 2022

Under the EB-5 Reform and Integrity Act of 2022 (RIA), Regional Centers are required to pay $20,000 if they have more than 20 investors or $10,000 if fewer. These payments are mandated to be collected into a designated “EB-5 Integrity Fund.” RIA requires regional centers to pay annually starting October 1, 2022, due every October 1 thereafter. USCIS is authorized to impose a “reasonable penalty” if not paid within 30 days of the due date.

However, as of September 29, 2022, the USCIS website reports that USCIS is drafting and will soon publish a public notice with instructions on paying the Integrity Fund fee.

This question is expected to be addressed during the October 19, 2022 USCIS EB-5 Stakeholder call, if not earlier. Also see IIUSA’s letter requesting an appropriate grace period here.

Please contact us if you have further questions on this or other aspect of RIA compliance.
