On October 1, 2024, Lubna Kably, Senior Editor at the Times of India, published a thoughtful and fact-based article on investor protections in EB-5. We invite you to take a moment to read the full article that includes quotes from Carolyn Lee.
The EB-5 visa program requires at-risk investments, consistent with the intent of the U.S. Congress to bring investment to real ventures where investors have real personal stakes. With the EB-5 Reform and Integrity Act of 2022, U.S. Congress also says that in no uncertain terms, our laws will, at the same time, protect EB-5 investors from non-compliant projects.
As Carolyn Lee mentions in the article, “The protections offered intend to cover good faith investors, who through no fault of their own are associated with terminated regional centers or debarred new commercial enterprises. These provisions are intended to confer generous remedies to affected investors, including age-out protection of children, preservation of priority date, and shielding from ‘material change’ challenges to their cases.”
